Jammu. J&K government has terminated four government employees from service in terms of sub-clause (c) of the proviso to clause (2) of Article 311 of the Constitution. The four employees include a doctor, a police constable, a teacher, and a lab bearer in the higher education department, due to their involvement in terror activities.
As per Order dated 21.11.2023 –
WHEREAS, the Lieutenant Governor is satisfied after considering the facts and circumstances of the case and on the basis of the information available, that the activities of Dr. Nisar-Ul-Hassan, Assistant Professor (Medicine), SMHS Hospital, Srinagar S/o Ghulam Hassan Ro Village Achabal, Sopore, Baramulla are such as to warrant his dismissal from service;
Lieutenant Governor is satisfied under sub-clause (c) of the proviso to clause (2) of Article 311 of the Constitution of India that in the interest of the security of the State, it is not expedient to hold an enquiry in the case of Dr. Nisar-Ul-Hassan, Assistant Professor (Medicine), SMHS Hospital. Accordingly, the Lieutenant Governor hereby dismisses Dr. Nisar-Ul-Hassan, Assistant Professor (Medicine), SMHS Hospital from service, with immediate effect.
Lieutenant Governor is satisfied under sub-clause (c) of the proviso to clause (2) of Article 311 of the Constitution of India that in the interest of the security of the State, it is not expedient to hold an enquiry in the case of Mr. Farooq Ahmad Mir, Teacher in Education Department S/o Gh. Ahmad Mir R/o Malik Mohalla, District Kupwara, A/P Usmanabad, District Kupwara. Accordingly, the Lieutenant Governor hereby dismisses Mr. Farooq Ahmad Mir, Teacher in Education Department from service, with immediate effect.
Lieutenant Governor is satisfied under sub-clause (c) of the proviso to clause (2) of Article 311 of the Constitution of India that in the interest of the security of the State, it is not expedient to hold an enquiry in the case of Mr. Ab. Salam Rather, Laboratory Bearer in Higher Education Department S/o Gh. Mohd Rather R/o Yamrach, Yaripora, Kulgam. Accordingly, the Lieutenant Governor hereby dismisses Mr. Ab. Salam Rather, Laboratory Bearer in Higher Education Department from service, with immediate effect.
Lieutenant Governor is satisfied under sub-clause (C) of the proviso to clause (2) of Article 311 of the Constitution of India that in the interest of the security of the State, it is not expedient to hold an enquiry in the case of Mr. Abdul Majeed Bhat, Constable in J&K Police S/o Wali Mohd. Bhat R/o Kunan, Kupwara. Mr. Abdul Majeed Binat, Constable in J&K Police from service, with immediate effect.
Prior to this in July 2023, J&K government had dismissed three government employees over their links with Pakistan based terror groups.
Article 311(2)(C) allows the government to terminate employees without seeking an explanation from them or ordering an inquiry into their conduct. Over the last 22 months, the J&K government has terminated the services of around 56 employees for being a “threat” to the security of the state.
